End-User License Agreement (EULA) for LetPlant®

Effective Date: 10/09/2023

This End-User License Agreement (“EULA”) is a legal agreement between you (“User”) and LetPlant (“Company”) governing your use of the LetPlant software application (“App”). By downloading, installing, or using the App, you agree to be bound by the terms and conditions of this EULA.

1. License Grant

LetPlant grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes, subject to the terms and conditions set forth in this EULA.

2. License Restrictions

You agree not to:

  • Modify, reverse engineer, decompile, or disassemble the App, except as permitted by law.
  • Use the App for any illegal or unauthorized purpose.
  • Transfer, sublicense, lease, or rent the App to any third party.
  • Remove or obscure any proprietary notices or labels contained within the App.

3. Ownership

The App is the property of LetPlant and is protected by copyright and other intellectual property laws. All rights, title, and interest in and to the App, including all associated intellectual property rights, remain with LetPlant.

4. Updates and Upgrades

LetPlant may, from time to time, provide updates, upgrades, or patches for the App. These updates are intended to improve, enhance, or modify the App and may be provided automatically without notice. You agree to accept such updates under the terms of this EULA.

5. Data Collection and Privacy

By using the App, you consent to LetPlant’s collection, use, and storage of certain data as described in our Privacy Policy. This may include data necessary for the functionality of the App, such as plant identification and user preferences.

6. Termination

This EULA is effective until terminated. LetPlant may terminate this EULA at any time if you violate its terms or if the App is discontinued. Upon termination, you must cease all use of the App and uninstall it from your devices.

7. Disclaimer of Warranties

The App is provided “as is” and “as available,” without warranty of any kind. LetPlant disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. LetPlant does not guarantee that the App will be error-free or uninterrupted.

8. Limitation of Liability

To the maximum extent permitted by law, LetPlant shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the App. This includes, but is not limited to, damages for loss of profits, data, or other intangible losses.

9. Governing Law

This EULA is governed by and construed in accordance with the laws of England and Wales, without regard to its conflict of law principles. Any disputes arising from or related to this EULA shall be resolved in the courts of England and Wales.

10. Severability

If any provision of this EULA is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

11. Entire Agreement

This EULA constitutes the entire agreement between you and LetPlant concerning the App and supersedes any prior agreements or understandings, whether written or oral.
